Noise, Dust, Smoke and Odour

NOISE

Environmental Health Services is responsible for the regulation of State Government?legislation relating to residential nuisance (any nuisance being caused by a commercial operator is the responsibility of the Environmental Protection Agency).

It is also important to note that Council has no jurisdiction over the following:

  • Noise from music and parties - QLD Police Service
  • Noise from licensed premises including restaurants and nightclubs - Liquor Licensing (Division of the Department of Tourism, Racing and Fair Trading).

Noise generated from regulated devices (including lawn mowers and power tools) is limited to the following times:

Monday-Saturday 7am to 7pm

Sundays and Public Holidays 8am to 7pm

(Monday-Saturday 7pm to 7am No audible noise permitted)

(Sundays and Public Holidays 7pm to 8am no audible noise permitted)

However, builders conducting building works under a development approval need to comply with a different set of times. These times only apply to work which has required a building approval from the Council. Any other minor works such as fencing or general landscaping need to be done within the times stated above.

Building Works

Monday-Saturday 6:30am to 6:30pm Noise permitted

Sundays and Public Holidays No audible noise permitted

DUST, SMOKE AND ODOUR

It is an offence under the Environmental Protection Act to cause nuisance by way of dust, smoke or odour. An on the spot fine of $300 for individuals and $600 for companies may be given where a notice to cease the nuisance has not been complied with. A notice may be issued based on the following:

  • How long it lasts
  • How often it occurs
  • The impact on the environment and neighbouring residences
  • The views of the complainants
